Kenneth R. Melvin was tried before a jury on the charge of attempted first-degree murder. The trial court submitted to the jury a verdict involving attempted first-degree murder (secs. 940.01 and 939.32, Stats.), the included offense of endangering safety by conduct regardless of life (sec. 941.30), and not guilty. The jury found Melvin guilty of endangering safety by conduct regardless of life and he was sentenced by the court to an indeterminate term in the state prison not to exceed five years. His motion for a new trial was denied and Melvin appeals.
